EMERGENCY ORDINANCE no. 225 of December 30, 2020 on amending normative acts and establishing measures in the field of agriculture.

Article 6 of the Water Law (No. 107 of 1996) shall be amended to add the following wording: “Provided that, within 6 months from the signing of the use and (or) operation contract, the beneficiary does not install equipment for measuring the quantities of water used and discharged, the National Administration "Romanian Water" shall have the right to install measuring equipment at his expense, following that cost to be recovered by adding the equivalent value to the invoice to the user. The user must ensure access and all the necessary conditions for the representatives of the National Administration "Romanian Water" in this regard. The provisions of par. (1) shall also apply to beneficiaries who signed use and operation contract before the entry into force of this law. The term provided in par. (1) shall be calculated from the date of entry into force of this Law. In case of non-compliance with the obligations provided in par. (1) and (2), the user will pay the equivalent value of the maximum authorized flow. By exception from the provisions of par. (3), in case of non-existence or proven technical impossibility of mounting flow or volume measuring devices, indirect metering methods shall be applied, by reporting the maximum authorized flow at the actual time of use for electricity production, the user having the obligation to communicate data generated by compliant time-measuring devices. Within the term provided in par. (1) and (2), the user communicates to the operator a request for the application of the provisions of par. (4) at the end of the conclusion of operation contract, and submits the proof of the non-existence or technical impossibility of mounting the measuring devices for flow or volume.”
