Emergency Ordinance No. 34 of June 27, 2012 for the establishment of the institutional framework of action for the purpose of the sustainable use of pesticides on the territory of Romania.

This Emergency Ordinance establishes the institutional framework for achieving the sustainable use of pesticides, by reducing the risks and their effects on human health and the environment, including by promoting integrated pest management and alternative approaches and techniques, such as alternative non-chemical methods for pesticides. The National Action Plan contains quantitative objectives, measures and timetables to reduce the risks and effects of pesticide use on human health and the environment and to encourage the introduction and development of integrated pest management and alternative approaches or techniques to reduce dependence on pesticide use. The National Action Plan must be revised at least once every 5 years and any significant modification thereof is notified to the European Commission as soon as possible. Pesticide distributors have the obligation to provide customers with complete information on the use of pesticides, the risks to human health and the environment, as well as instructions and safety measures related to the management of these risks for the products in cause. Plant protection products classified as toxic, highly toxic, harmful and irritating, used by professionals, must be accompanied by technical sheets with safety data translated into Romanian. Distributors who sell pesticides to non-professional users are obliged to provide general information on the risks to human health and the environment associated with the use of pesticides, in particular with regard to: hazards, exposure, appropriate storage conditions, handling, application and safe disposal of waste in accordance with current waste legislation, as well as regarding alternative solutions with minimum risk.
