Abstract
This Emergency Ordinance establishes an immediate intervention protocol to address the safety risks posed by brown bears within and near human settlements. Its primary objective is to protect human life, physical integrity, and private property by streamlining the decision-making process for local authorities. It identifies specific behavioral criteria for animals that represent a direct threat and provides a clear legal basis for neutralizing these risks through localized action.
A central feature of the Ordinance is the removal of requirements for a gradual escalation of force in high-risk scenarios. Local intervention teams, led by municipal officials and supported by specialized security and technical personnel, are authorized to move directly to lethal measures if an animal is deemed aggressive or habituated to human environments. This shift allows for a more rapid response to incidents where non-lethal deterrents or relocation efforts are determined to be insufficient or impractical for ensuring public safety.
The Ordinance also introduces strict prohibitions on human activities that contribute to wildlife habituation. It specifically forbids the feeding of bears and mandates a minimum safety distance for observers, backed by significant financial penalties. These measures are designed to reduce the frequency of human-bear encounters by discouraging behaviors that draw animals into populated areas. Authorities are further empowered to use digital and video evidence to enforce these sanctions against individuals who interact with protected wildlife in a prohibited manner.
Administrative and financial responsibilities are clarified to ensure the functional readiness of intervention teams across different jurisdictions. The Ordinance requires local governments to maintain active service contracts with essential technical and veterinary staff, while providing a system for the central government to reimburse the costs associated with these emergency operations.
