Abstract
This Ordinance focuses on the reorganization of state authorities responsible for the management of non-renewable resources and the establishment of a new legal regime for carbon management.
The Ordinance establishes the National Regulatory Authority for Mining, Petroleum, and Geological Storage of Carbon Dioxide (ANRMPSG). This body replaces the previous National Agency for Mineral Resources, centralizing the oversight of extraction activities and geological storage under a single administrative entity. The authority possesses financial autonomy and expanded technical mandates to oversee the lifecycle of resource exploitation.
Provisions within the Ordinance introduce a specific legal category for the geological storage of carbon dioxide. This includes the definition of "pore space" as a state-owned asset and the creation of licensing procedures for the permanent underground injection of greenhouse gases. These measures establish a mandatory operational link between traditional hydrocarbon production and the development of storage capacity.
The Ordinance modifies existing legislation to prioritize the identification and exploitation of mineral resources deemed critical for industrial development. It grants the new authority the power to designate certain extraction sites as strategic projects, which allows for specialized administrative handling. This includes the recovery of secondary materials from legacy mining waste to maximize resource efficiency.
Operational standards for technical and financial transparency are strengthened throughout the Ordinance. Companies seeking licenses must undergo more rigorous verification of their capacity to execute land reclamation and environmental closure. The Ordinance also mandates the digitalization of national resource registries to ensure more accurate monitoring of concession agreements and royalty collections.
