Government Decision No. 621 regarding management of packaging materials and packaging waste.

This Government Decision regulates the management of packaging materials and packaging waste in order to prevent or reduce the impact on the environment. The provisions of this Government Decision shall be applicable in compliance with the existing specific quality provisions for packaging regarding the safety, health protection and hygiene of the packaged products, transport requirements and the rules regarding the management of hazardous waste. All packaging materials introduced on the market are subject to the provisions of this Government Decision, regardless of the material from which they were manufactured, modalities of use in economic, commercial activities, in the households of the population or in any other activities, as well as all packaging waste, regardless of the way of generation. The principles specific to the packaging waste management activity are: (a) prevention of the generation of packaging waste; (b) reuse of packaging; (c) recycling of packaging waste; and (d) other forms of valorization of packaging waste leading to the reduction of the quantities removed through final storage. Economic operators who produce reusable packaging are obliged to comply, in the process of manufacturing of packaging materials, the essential requirements regarding the reusable character of a packaging provided for in point 2 of Annex No. 2, so that they correspond to multiple reuses. Economic operators who produce and/or sell products packed in reusable packaging are obliged to apply the warehouse system in order to ensure an optimal number of cycles of its use. Economic operators who produce products packaged in reusable packaging are obliged to organize a collection system, with a view to multiple reuse of the packaging, through economic operators who sell these products or through specialized collection centers of these types of packaging.
