Abstract
This Government Decision establishes the legal framework for the classification, packaging and labelling of dangerous preparations on the market and contains special provisions for certain preparations, which may present danger, classified or not as dangerous within the meaning of this Government Decision. For the application of this decision, the following institutions are designated as competent authorities: (a) Ministry of Environment and Forests - coordination and regulatory authority; (b) National Agency for Environmental Protection - implementing authority; and ( c) The National Environmental Guard and the National Authority for Consumer Protection - control and inspection authorities. It shall be applicable also to plastic materials. The evaluation of the dangers that a preparation may present is based on the determination of the following properties: (a) physical-chemical; (b) affecting health; and (c) affecting the environment. In cases where laboratory tests are performed, they must be performed on the preparation, in the form in which it is introduced on the market. The dangerous preparation must be classified taking into account the following elements: (a) the effects of the preparation on humans, if it can be demonstrated through epidemiological studies, by scientifically validated case studies, or through practical experience, based on statistics, such as evaluating data provided by toxicological information centers or those related to occupational diseases, causing toxicological effects on humans; (b) effects such as potentiation, if it can be demonstrated that due to such effects a conventional assessment could underestimate the danger due to the toxicity of the preparation; and (c) effects such as antagonism, if it is possible to demonstrate that because of these effects a conventional assessment could overestimate the danger caused by the toxicity of the preparation.
