Abstract
The procedure for placing biocidal products on the market in Romania is established according to the provisions of this Government Decision. The competent authority for regulating the regime of biocidal products in Romania is the Ministry of Health. In order to fulfill the duties regarding the authorization and registration of biocidal products on the territory of Romania, the National Commission for Biocidal Products is established, a specialized body, without legal personality, which operates under the Ministry of Health. Biocidal products shall be intended active substances and preparations containing one or more active substances, conditioned in a form in which they are provided to the user, with the aim of destroying, preventing, rendering harmless and preventing the action or exercising another control effect on any harmful organism, by chemical or biological means. Harmful organisms shall be intended any of the organisms that have an unwanted presence or a harmful effect on people, on their activities or on the products they use or produce, for animals or for the environment. The biocidal products to which this Decision applies are classified into 23 types of biocidal products from the following main groups: (a) group 1 disinfectants and biocidal products in general; (b) group 2 preservatives; (c) group 3 non-agricultural pesticides; and (d) group 4 other biocidal products. Biocidal products are placed on the market and used on the territory of Romania only if they are authorized in accordance with the provisions of this Decision. The placing on the market and the use of basic substances for biocidal purposes are prohibited, if they have not been included in the List of basic substances approved by the European Community. The appropriate use of biocidal products implies the rational application of some combination of physical, biological, chemical or other measures, so that the use of biocidal products is limited to the minimum necessary.
