Joint Order of the Ministry of Regional Development and Public Administration and of the National Regulatory Authority for Community Services of Public Utilities validating Guidelines establishing the procedures determining deviations from the regulations regarding community public utility services and the method of applying sanctions envisaged by specific legislation and the Prevention Law No. 270/2017.

These Guidelines establish the procedures determining deviations from the regulations regarding community public utility services and the method of applying sanctions envisaged by specific legislation and the Prevention Law No. 270/2017. They also establish the rights and obligations of local public administration and operators of community public utility services. National Regulatory Authority for Community Services of Public Utilities (A.N.R.S.C.) is the competent regulatory authority for the following public utility services: (a) water supply and sewerage; and (b) sanitation of localities. A.N.R.S.C. exercises its public authority prerogatives in conditions of equidistance and balance both towards users and operators, as well as towards local public administration authorities. Local public administration authorities at the level of basic administrative units, cities, municipalities, districts, the municipality of Bucharest and, as the case may be, under the conditions of the law, at the level of administrative-territorial subdivisions of municipalities or at the level of inter-community development associations have exclusive competence, under the conditions of the law , in everything regarding the establishment, organization, management and operation of public utility services, as well as regarding the creation, development, modernization, rehabilitation and exploitation of public or private property of the administrative-territorial units that make up the public utility systems.
