Abstract
This Law amends and supplements the Water Law of 1996 with respect to the protection and preservation of water resources and the conditions for carrying out certain activities regarding water resources. Its provisions concern, among other things, the registration of public waters rights in the Land Book (state property right over the public domain goods), facilitation of the development of public and private investments (and use of lands in the public water domain), improvement of water protection and preservation (restriction on unreasonable use of water resources) and use of groundwater for irrigation.
The amending Law seeks to accelerate the registration with the Land Book of the public property of waters and land areas of riverbeds under the management of the "Romanian Waters" National Administration (“Water Administration”). It is also about the use of lands included in the public regime of waters, which can be subject of concession or lease agreements by the Romanian state. Some projects may be subject to a protocol between the interested central or local public authority and the Water Administration, with the express consent of the Ministry of Environment, Waters and Forests.
The law modifies the permit and authorization regime by, among other things, allowing such titles to be transferred from one project holder to another, provided that the conditions established therein have been fully complied with. The Law also concerns protection of water resources. For example, groundwater may be used for irrigation only if no surface water is available. Some provisions concern water pollution.
