Abstract
Agrarian reform is a national, economic and social necessity for the country. Romania's agriculture will rely on strong, healthy and productive households, on households that are the private property of those who own them. The purpose of the agrarian reform is: (a) increasing the arable areas of the existing peasant households, which have less than 5 ha; (b) creation of new individual peasant households for landless agricultural workers; (c) the establishment of vegetable gardens near cities and industrial towns for the supply of workers, officials and tradesmen; and (d) reserving some land for agricultural schools and model experimental farms in order to raise the level of agricultural crops, the production of selected seeds, the raising of cattle and the creation and development of the agricultural industry, land that will be under the administration of the state. The following land categories shall be subject to expropriation: (a) agricultural land of absentees; (b) agricultural land of those who in the last seven consecutive years have not cultivated their land under their own management, with the exception of lots up to 10 ha; (c) agricultural assets of any kind belonging to Romanian citizens who volunteered to fight against the United Nations; (d) dead hand assets; and (e) surplus agricultural land constituting properties of natural persons that exceed the surface of 50 ha, namely: arable land, orchards, hayfields, ponds and artificial ponds, whether or not they serve for fishing, swamps and floodplains. The size of the plots of newly created households, as well as the size of the plots of small households, will be determined in relation to the existing land reserve within the grid radius. It shall also be applicable to the hayfields and ponds. The households created on the basis of this decree-law cannot be divided, sold, leased, or mortgaged, neither in their entirety nor in part. In exceptional cases, newly created households can be sold, leased, divided or mortgaged, only with the approval of the Ministry of Agriculture. The owner receives the land free of any debts and obligations and encumbrances.
