Order No. 1.337 of the Ministry of Environment, Water and Forests validating METHODOLOGICAL NORMS from June 10, 2022 on the control of shipments of waste.

The purpose of these Methodological Rules shall be to organize, supervise and control shipments of waste in such a way as to take account of the need to preserve, protect and improve the quality of the environment and human health. The provisions of the present Methodological Rules shall apply to all authorities, public institutions, as well as economic operators. The import/transfer of any type or quantity of waste in Romania may be carried out only to recovery facilities, as defined in these methodological rules, exclusively for itself, without being able to transfer their ownership to other entities, which it could also carry out capitalization operations before mandatory capitalization operations are carried out. The import/transfer of waste of any kind in Romania, in order to eliminate it, is prohibited. The transfer of waste shall take place only after it has been certified that the recovery facility has the technical capabilities in relation to the types, categories and quantities of waste for which a shipment is planned, in accordance with environmental protection regulations and with the declarations submitted to the ROAFM register. When planning a shipment, the economic operator shall ensure that the waste in its entirety is received at the recovery facilities. The specialized control for waste transfer organized in the designated points of crossing the state border of Romania is mandatory and is carried out by the commissioners of the National Environmental Guard (GNM), at the request of the representatives of the Romanian Border Police regarding the general control of the means of transport in the area of competence.
