Order No. 1.789 of the Ministry of the Environment and Sustainable Development validating the Procedure for issuing of environmental permit.

This Procedure regulates the conditions for requesting, issuing and reviewing the environmental authorization. The provisions of this Procedure apply to the regulation from the point of view of environmental protection of the activities provided for in Annex No. 1. The competent authority for carrying out the procedure for issuing the environmental authorization is, as the case may be, the central public authority for environmental protection, the National Agency for Environmental Protection or the territorial public authority for environmental protection. Requesting and obtaining environmental authorization are mandatory both for carrying out existing activities and for starting new activities. For the activities of zoos, public aquariums and rehabilitation and/or care centers, the presented documentation also contains the specific requirements provided in Annex No. 5. The compliance program is required for any activity that has an impact on the environment through current or previous operation. The quantification of the actual impact of an activity on a site is carried out through the environmental balance sheet, reporting the state of the environment and the necessary remedial measures to the standards and regulations in force. For the activities of placing on the market, use, recovery, recycling of certain fluorinated gases with a greenhouse effect shall be applicable the provisions of Regulation No. 842/2006 of the European Parliament and of the Council of the European Union regarding certain fluorinated gases with a greenhouse effect. The environmental authorization contains all the obligations regarding the protection of the environment during the execution of the works related to the exploitation and after exploitation.
