Abstract
This Order sets out the rules for regulating the commercial exploitation of Romania’s biological and geological natural resources, balancing economic interests with strict conservation imperatives. The Order governs the harvesting, capture, and trade of wild flora and fauna—including terrestrial and aquatic species—as well as "flowers of the mine" (mineral specimens) and fossils of both vertebrate and invertebrate origin. The Order applies to these resources in various states, whether they are live, dead, or semi-processed, and covers their movement within the national territory as well as their export and import.
There is a focus on sustainability and scientific oversight. The Order prohibits the exploitation of species declared as monuments of nature, endemic, or endangered, and restricts any harvesting activities within scientific reserves or strictly protected ecological zones. To ensure that removals do not lead to population collapse or ecological imbalance, the issuance of permits is contingent upon annual resource evaluation studies. These studies must be conducted by specialized research institutes and undergo technical validation by a dedicated commission of the Romanian Academy, ensuring that harvest quotas remain within scientifically sound limits.
The administrative burden of the Order is shared between local and national authorities, creating a decentralized yet standardized system of control. Local environmental protection agencies manage the day-to-day authorization of individual and corporate harvesters, while the central ministry oversees the international trade of these resources to ensure compliance with global environmental standards. This entire process is supported by fifteen detailed annexes that provide the necessary technical infrastructure, ranging from standardized application forms and permit templates to comprehensive fee schedules and stock verification minutes, thereby creating a transparent and traceable legal path for the utilization of Romania's natural heritage.
