Order No. 723 of the Ministry of Environment, Waters and Forests validating the procedure for intervention and prevention in the case of brown bear species (Ursus arctos) with a view of protecting health and safety of the population and in order to prevent significant damages.

This Order establishes for the brown bear species the maximum number of exemptions applicable at national level, regulates the level of intervention and prevention, as well as the conditions for implementing derogations from the status of strictly protected species, established by the national environmental legislation in force, provided that there is no acceptable alternative, and the derogatory measures are not detrimental to maintaining the populations of the mentioned species in a state of favorable conservation in their natural habitat, only in the following situations: (a) to prevent significant damage, especially to agricultural crops, domestic animals and to prevent significant damage to other assets; (b ) in the interest of public health and safety. This Order authorizes capture of brown bear species and relocation thereof that shall be carried out only by specialized and authorized staff. It specifies the authorized areas and municipalities for capture and relocation of brown bear species.
