Abstract
This Decree determines the protected wild species of flora, fauna and fungi whose collection from natural habitats, use and trade is brought under control and determines the amount of compensation for their use.
For protected species, for the purposes of this Decree, the following shall be determined: 1) wild species belonging to sensitive or rare species that are not in danger of extinction; 2) wild species that are not endangered, but can easily be replaced with endangered wild species due to a similar appearance, and 3) species whose appropriate method of protection is prescribed by a ratified international agreement. The collection, use and trade of protected species is brought under control in order to ensure their sustainable use by preventing the collection of these species from natural habitats in quantities and in a way that would endanger their future survival, structure and stability of living communities. Articles 21 and 22 are setting out the penalty provisions.
The Annex is also part of this publication (Annex 1: Wild flora protected by control on its collection, use and trade; Annex 2-Wild fauna protected by control on its collection, use and trade; Annex 3-Ratio of quantities of protected species in fresh and dry or processed state; and Annex 4-Administrative form).
