Abstract
This Law provides for water regulation and rules to protect and control waters in the Republic of Serbia.
The Law consists of 11 Chapters: General provisions (I);Water areas (II);Water regime (III); Water sector activities (IV); Restrictions on the use of water (V); Public water institution (VI); Farmer cooperatives (VII); Financing of water activities (VIII); Water inspections (IX); Penalties (X); Final provisions (XI).
The Law treats all kinds of water: surface and groundwater, and thermal and mineral water. It provides a complete regulation on safety, water status and pollution inside state borders, also including waters that are between two or more countries. It stipulates that water is a common good that every person has a right to use. The Serbian government is responsible for the maintenance and the conditions of water facilities.
Permits will be required for various activities including exploitation of natural resources and discharge of wastewater into natural or artificial basins. This Law provides for the establishment of the “Srbijavode” a unique public water company, and it defines its internal organization and its powers and functions.
