Agreement between the Government of the Russian Federation, the Government of Hungary and the Cabinet of Ministers of Ukraine on the transportation of nuclear materials between the Russian Federation and Hungary through the territory of Ukraine.

The Parties shall cooperate in order to ensure the transportation of fresh and spent nuclear fuel, other categories of nuclear materials that relate to the nuclear fuel cycle, natural uranium, radioactive substances produced as a result of the reprocessing of spent nuclear fuel, and empty transport packaging for such materials from the Russian Federation to Hungary and from Hungary to the Russian Federation by transit through the territory of Ukraine. Import to the territory and export from the territory of the Parties of special cargoes shall be carried out in accordance with the legislation of each Party, as well as for the Russian Federation in accordance with legal acts of the Customs Union and the Common Economic Area, and for Hungary by the legislation of the European Union, in particular, in accordance with legislative provisions of the European Union related to nuclear energy. The competent bodies of the Parties for the implementation of this Agreement shall be: (a) for the Russian Federation the State Nuclear Energy Corporation "Rosatom"; (b) for Hungary the State Department for Nuclear Energy of Hungary; and (c) for Ukraine the State Inspectorate for Nuclear Regulation of Ukraine. Transportation of special cargoes shall be carried out by railway transport, in direct uninterrupted traffic on the territory of the Russian Federation, Ukraine and Hungary. The crossing of the state borders of the Parties by the personnel of escorting special cargoes and guards, the movement of special cargoes across the state borders, as well as the arming and equipping of the guards and escort personnel in accordance with the legislation of each of the Parties, as well as for the Russian Federation shall be regulated by legal acts of the Customs Union and the Common Economic Area, and for Hungary by the legislation of the European Union, in particular, the legal norms of the European Union related to nuclear energy. Mandatory condition for carrying out the transportation of special cargoes under this Agreement shall be the availability of contracts concluded by legal entities of the Russian Federation and Hungary.
