Governmental Decree No. 59 validating the Regulation on compensation for losses in case of deterioration in the quality of land, restriction of the rights of owners of land plots, land users, landowners and tenants of land plots, as well as right holders of real estate objects located on land plots.

This Regulation establishes: (a) the procedure for determining the composition and amount of losses provided for Chapter VIII of the Land Code of the Russian Federation; (b) the procedure for concluding an agreement on indemnification and conditions of such an agreement; (c) the procedure for concluding an agreement on the purchase of a land plot and (or) other real estate object due to the impossibility of their use in accordance with the previously established authorized use as a result of the establishment or modification of a zone with special terms of use of the territory; (d) the procedure for compensation for losses provided for in Chapter VIII Land Code of the Russian Federation; (e) the procedure for providing compensation for the termination of rights to land due to the impossibility of its use in accordance with previously established authorized use as a result of establishing or modifying a zone with special conditions of use of territories; and (f) cases and rules for taking into account the payment for a public easement when indemnifying losses caused in connection with the establishment or change of the zone with special conditions for the use of the territory as a result of the implementation of activities for which a public easement has been established. The composition of losses is determined on the basis of the need for full compensation for damages to the person whose right has been violated. The amount of losses is determined by adding the size of the real damage incurred by the owner of the land plot and (or) object of real estate, and the amount of lost profits of this person.
