Abstract
Application form for obtaining patent must be forwarded to State Commission of the Russian Federation on testing and protection of selection achievements attached to the Ministry of Agriculture and Food in accordance with the list of species (variety) that are subject to protection in the Russian Federation validated by State Commission. In order to carry out testing of a selection achievement for the purpose of establishing its protection pre-requisites in the next in turn agricultural season the application form must be forwarded not over than the 15th of January for winter crops, fruit species and grape and not over than the 1st of December for all other crops and species. The selectionist or his legal successor have the right to forward application form and obtain patent for selection achievements. In case of selection, creation or making known selection achievements in the process of fulfilling official duties or functions, employer if otherwise is not envisaged between employer and employee must forward the application form. The application form must contain the following information: 1). Application form for obtaining patent in accordance with forms No.301 (subjoined in the Annex to the present Instructions). 2). Form of species or variety compiled in accordance with the established modalities in triplicate. 3). Authorization ensuring the right of the declarant to forward the application form (for legal successors and intermediaries). 4). Certificate ensuring payment of dues for forwarding the application form and its preliminary expertise.
