Ministerial Decree No. 367 implementing Article 54 of the Federal Law No. 166-FZ on fisheries and conservation of aquatic biological resources.

This Ministerial Decree establishes the modalities of trade and destruction of the expropriated without compensation or confiscated aquatic biological resources and derivates thereof, including caviar. It is understood that expropriated without compensation and confiscated resources are illegally caught (harvested). The decision on release into the natural habitat or destruction of aquatic biological resources and derivates thereof, including caviar, shall be made by the officials of the Ministry of Interior, Federal Security Service and Federal Veterinary and Phytosanitary Supervision Service. In case of the release into the natural habitat it shall be specified in the report the amount of aquatic biological resources, place, date and time of release. In the report on the destruction of aquatic biological resources it shall be specified the amount thereof, place, date, time and the modality of destruction. The Annex contains the list of species subject to immediate release into natural habitat or destruction composed of sturgeon species, salmon species, crustaceans and molluscs.
