Regional Law No. 2860-ZRK “On the establishment in of requirements, subject to which the territories where citizens conduct gardening for their own needs can be included within the boundaries of a populated area, or a new populated area can be formed within the boundaries of the territory where citizens conduct gardening for their own needs.”

This Regional Law establishes requirements, subject to which the territories where citizens conduct gardening for their own needs can be included within the boundaries of a settlement or a new settlement can be formed within the boundaries of the gardening territory. The gardening territory may be included within the boundaries of a populated area if the following requirements are met: (a) the boundaries of the gardening area must be adjacent to the boundaries of the populated area or the distance between them should not exceed 500 meters; (b) the number of land plots with residential buildings must be at least 50 percent of the total number of land plots in the gardening area; and (c) existence of a decision of the general meeting of members of a gardening non-profit partnership, horticultural or peri-urban non-profit partnership on the inclusion of the gardening territory within the boundaries of the populated area. The inclusion of individual (separate) land plots of gardening territory within the boundaries of a populated area is not permitted. A new settlement may be formed within the boundaries of the gardening territory if the following requirements are met: (a) the number of land plots with residential buildings must be at least 50 percent of the total number of land plots in the gardening area; and (b) existence of a decision of the general meeting of members of a gardening non-profit partnership, horticultural or peri-urban non-profit partnership on the formation of a new settlement.
