Abstract
This Act regulates the placing on the market of food (as defined in sect. 2) in the Solomon Islands and the importation and exportation of food, and provides for the establishment of the Pure Food Advisory Board and other matters of administration and enforcement.
The Act consists of 37 sections divided into 8 Parts: Preliminary (I); Offences in the presentation for sale of adulterated or falsely described food (II); Offences relating to apparatus, packaging and labelling (III); Inspection and analysis (IV); General enforcement procedures (V); Importing and exporting food (VI); Legal proceedings (VII); Administration (VIII).
Together with providing a list of interpretations, section 2 also defines the application sphere of the Act. The Minister may, by notice in the Gazette, appoint health inspectors and analysts for the purpose of this Act. The Head of The Environmental Health Department or Division (“Director”) or provincial authority as the case may be, shall cause inspections of premises of prescribed businesses to be performed in the manner prescribed by Regulations (Part IV, sects. 8-10). Food may be condemned by a Magistrate pursuant to section 11. Section 19 of Part V prescribes that the Minister may prohibit, by Order, the cultivation, taking, harvesting, or otherwise obtaining any food from any area if, in the opinion of the Minister upon the advice of the Pure Food Advisory Board, that food may be dangerous or injurious to persons who consume that food. Provisions of Part VI concern the notification of import of food and the inspection and sampling of such food and the certification of production plants for food to be exported. A HACCP procedure or equivalent shall be in place for such plant. The Pure Food Advisory Board is established under section 34. The Minister shall appoint the Director of Livestock and Veterinary Services and a senior meat and dairy hygiene inspector and other meat and dairy hygiene inspector for purposes of control of the slaughter of livestock (sect. 35). The same section also requires livestock to be slaughtered in a registered slaughterhouse and provide for the licensing of dairy operations. Section 37 provides for regulation-making powers of the Minister. (Completed by 10 Schedules)
