Abstract
This Act contains provisions for the regulation of various activities and rights in respect of rivers. “River” includes any watercourse whether natural or artificial and any dam, lake, pond, swamp, marsh or other body of water forming part of that watercourse. The Minister may appoint inspectors for purposes of this Act under section 3 and prohibit, by Order, the construction of erections in the flood channel of any river, where the flow may be obstructed. Section 5 defines offences in relation to rivers, including of felling of trees that falls into a river, diverting of water, and the damaging of banks. Inspectors may order removal of obstacles, etc. pursuant to section 6. Section 7 concerns permits to divert water to be granted by the Minister. The Minister may grant in certain circumstances easements to persons that have obtained a permit under section 7 to divert water. Such easements shall be registered pursuant to section 10. Notice and the right to make representations shall be given to persons that may be adversely affected by the grant of an easement (sect. 12). Other provisions of this Ordinance concern legal proceedings, presumptions of guilt, liability for damage, appeals, payment to court, and prescribe miscellaneous offences. Section 19 defines regulation making powers of the Minister.
