Physical Planning (Control of Development of Land) Regulations, 2023 (S.I. 89 of 2023).

These Regulations are made in exercise of the powers conferred by Part IV of the Physical Planning Act, 2021 (Act). Regulation 2 provides for the requirements of an application for permission to develop land under section 36 of the Act. The requirements for public consultation process are laid down (Reg. 4). The procedure for dealing with application for development received by the Authority is provided under Regulation 5. Regulation 6 contains the matters to be taken into considerations when dealing with an application for development. Regulation 7 provides for application of conceptual approval of proposed development. The Authority is required to keep a register of all application for permission to develop along with other particulars as mentioned therein (Reg. 9). The Regulations contain the matters which may be contained in the Tree Preservation Order and Building Preservation Order to be made under section 48 of the Act. The procedure to be followed before making these Orders is laid down. An applicant aggrieved by the decision of the Authority may appeal to the Appeals Board (Reg. 18).
