Trade of Wild Fauna and Flora Act, 2021.(Act 27 of 2021).

This Act, which is composed of 6 Parts and 1 Schedule, gives effect to the Convention on International Trade in Endangered Species of Wild Fauna and Flora and applies to trade of endangered species listed in appendix I, II or III to the Convention, as may be amended from time to time. The Act does not apply to any species specified in an appendix to the Convention in relation to which Seychelles has made a reservation but the Minister may, by regulations, extend the application of this Act to any animal or plant to which this Act does not apply by reason of subsections (1) or (2).
Part 2 is dedicated to the regulation of the Management Authority and the Scientific Authority (their functions and powers).
Part 3 covers the trade of endangered species: their Import and export; the re-export and introduction from the sea; the possession of endangered species and their transit through Seychelles; the breeding or propagation of endangered species; the power to require endangered species to be marked, branded or labelled.
Part 4 regulates the applications to obtain a permit to import or export any endangered species, a certificate to re-export or introduce from the sea any endangered species , a licence and a registration to produce captive bred animal or artificially propagated plant or animal of any endangered species for commercial trade purposes. It also regulates their cancellation and the appeal against any decision of the Management Authority in this regard.
Part 5 is about the enforcement powers for the purposes of this Act (arrest, search and seizure with warrant, power to enter premises, power to stop, search and seize conveyance, forfeiture of seized endangered species and their release) and the relevant proceedings.
Part 6 covers general issues: the compounding of offences; the false declarations; the penalty where no penalty is provided; the protection against suit and legal proceedings; the establishment, by the Minister, of rescue centres for the purposes of looking after the welfare of any living endangered species that was seized, confiscated, forfeited or abandoned etc. Schedule 1, describing the enforcement officers, terminates the Act.
