Abstract
This Law, consisting of 42 articles structured across eight Chapters, is designed to combat corruption in Sudan comprehensively, with a detailed description of various forms of corruption provided in Article 5. Article 6 introduces the Anti-Corruption and Public Funds Recovery Commission, outlining its primary goals as follows (i) safeguarding public and private finances, combating corruption across political, economic, and social spheres, and recovering misappropriated public funds and illicit gains; (ii) promoting transparency and integrity as fundamental principles in financial and administrative transactions; (iii) fostering individual accountability independent of one's role, emphasizing equality and justice; (iv) strengthening the influence of institutions and civil society organizations while raising awareness through various channels to prevent corruption; (v) executing Sudan's obligations under international and regional anti-corruption agreements; (vi) expanding and preserving the public's right to access information related to corruption matters. The Commission's primary functions encompass (i) formulating national anti-corruption policies, plans, and strategies. Monitoring the enactment of anti-corruption legislation; (ii) receiving and verifying complaints, gathering information, and initiating appropriate actions; (iii) conducting regular investigations.; (iv) disseminating an anti-corruption ethos to the public, emphasizing the significance of safeguarding public funds and assets for effective governance. The main bodies of the Commission are (i) the General Secretariat and (ii) the Investigation Unit.
The law also addresses the following key aspects (i) ensuring the Commission's independence; (ii) safeguarding whistleblowers and witnesses; (iii) facilitating international and domestic cooperation; (iv) preserving the confidentiality of information; (v) preventing immunity from legal consequences; (vi) addressing breaches of the Law's provisions.
