Abstract
This Act consists of 25 articles divided in VI Chapters. It establishes that any work related to irrigation or drainage provided needs a permit from the Ministry of Irrigation and Water Resources. The licensee shall notify the Ministry (i) to draw water for irrigation, whether from the Nile River or any of its tributaries or any other rivers or public canals; and (ii) to change the previous place referred to. The permits for projects that draw water shall be valid for a period of ten years from the date of granting the license and may be renewed for similar periods. To exploit new lands, not yet licensed for irrigation with water resources available in the State Plan, must submit an application to the Ministry for authorization containing the required data. The General Directorate of Irrigation Affairs issues licenses related to the irrigation of new land from public canals.
Article 15 prohibits in particular (i) discharge of any type of water in the public canals or into surface water without permission obtained from the Ministry; (ii) use drainage for irrigation without permission obtained from the Ministry; (iii) the waste of irrigation water disposed in any public or private banks or uncultivated or unlicensed land; (iv) disruption of water flow; (v) cut the bridges of canals or public banks; (vi) open basins and structures to collect water; (vii) dig in any of the lands owned by the State or privately owned. Article 18 states that any person affected by any of the actions or procedures related to irrigation or drainage carried out by the Ministry may submit his grievance to the Undersecretary of the Ministry.
