Abstract
This Regulation, consisting of 24 articles, establishes a comprehensive national framework governing access to genetic resources and associated traditional knowledge under State sovereignty, covering both in situ and ex situ resources. The Regulation creates a sovereignty-based, permit-driven access and benefit-sharing system grounded in prior informed consent, mutually agreed terms, State oversight, community participation, and enforceable compliance mechanisms. It regulates access procedures, benefit-sharing arrangements, and monitoring and enforcement mechanisms, while ensuring consistency with the Nagoya Protocol and the Convention on Biological Diversity. Its main objectives are to (i) create transparent and predictable access procedures; (ii) ensure fair and equitable sharing of monetary and non-monetary benefits; (iii) promote biodiversity conservation and sustainable use; (iv) combat biopiracy; (v) balance protection with lawful utilization of genetic resources. It also seeks to enhance public participation and strengthen institutional and human capacities. The Higher Council for Environment and Natural Resources is designated as the competent authority responsible for implementing and supervising the system. It grants and cancels permits, monitors compliance, establishes committees and checkpoints, maintains registries, and oversees benefit-sharing arrangements. The Secretary-General serves as the National Focal Point under the Nagoya Protocol, coordinating international cooperation, reporting, and information exchange through the Access and Benefit-Sharing (ABS) Clearing-House.
Access to genetic resources requires prior authorization, proof of prior informed consent, and the conclusion of mutually agreed-upon terms between the provider and the user. Permits are non-transferable and may be revoked if conditions are violated or information is falsified. Emergency procedures may apply in cases of disasters or health threats. The benefit-sharing regime mandates contractual agreements defining rights, obligations, intellectual property issues, and dispute resolution. Local communities are entitled to share in benefits, particularly for in situ resources, and must be involved in relevant decision-making processes. Compliance is ensured through internationally recognized certificates of compliance, monitoring by checkpoints, reporting obligations for users, and verification of imported resources. The Regulation applies to national authorities, users, providers, local communities, foreign States Parties, and relevant institutions, and governs activities ranging from collection and research to commercialization and cross-border cooperation.
