Abstract
This Law, consisting of 34 articles, aims at establishing in its Article 5 the Khartoum State Water Corporation, reconfirming the Khartoum State Water Corporation, initially established in 1995. The Authority aims to (i) ensure access to potable water for all residents; (ii) develop and manage the state's water resources to meet demand for clean, usable water; (iii) deliver comprehensive water services to consumers across all cities and villages, collaborating with relevant authorities; (iv) operate sustainably, covering both operational and rehabilitation costs; (v) supply water suitable for industrial use. Under Article 7, the Authority's responsibilities include (i) planning, designing, constructing, and maintaining water facilities and infrastructure to an appropriate standard; (ii) manufacturing, maintaining, and managing water machinery and equipment for use; (iii) granting licenses for water supply and the drilling of underground and surface wells, which includes conducting laboratory tests and supervising water quality and purity to prevent pollution; (iv) cutting and restoring water supply to consumers; (v) issuing water service bills and collecting fees; (vi) granting licenses for the exploitation and purification of drinking water for commercial, industrial, or other purposes; (vii) enhancing employee efficiency through training, qualification, and modernizing work methods; (viii) providing technical consultations to the government in the water sector. Article 29 prohibits any individual or entity from exploiting, purifying, supplying, or establishing any facilities for the extraction of surface or underground water in the state for commercial, drinking, industrial, personal, or any other purposes without a written license from the Authority. It also forbids undertaking any activity that causes or is likely to cause contamination of surface or underground drinking water.
The Law also includes provisions concerning (i) financial resources; (ii) Board of Directors and its powers, including approving the organizational and employment policies, staff terms, budgets, and financial statements; recommending water pricing, and monitoring; (iii) violations and penalties.
