Abstract
This amendment is composed of two parts. The first part, taking into account the issuance of the 2019 Interim Constitution, essentially aligns the language within the law with the new political context.
The second part establishes the Technical Body for Water Resources, operating under the supervision of the Minister of Irrigation and Water Resources. The primary responsibilities of this body are as follows: (i) to propose the overarching policy for water resource management and utilization; (ii) to inspect water systems and recommend maintenance actions to the responsible authorities (with the Ministry carrying out maintenance in case of non-compliance to preserve the systems); (iii) to prepare long-term water plans for presentation to Parliament for approval; (iv) to conduct research and studies pertaining to water resources and propose development plans; (v) to assess current and future water requirements and suggest plans for sustainable management; (vi) to lead the Sudanese delegation in the Joint Permanent Technical Authority for Nile Waters; and (vii) to represent Sudan in collaborative forums and negotiations with regional and international organizations on matters related to water resources. Many subsequent amendments change the wording "National Committee for the water resources" of the original law to the name of the new institution. At Article 13 specifies that water systems are the property of the State, and it is reiterated that water resources in general are also the property of the State. In Article 18, which delineates the Ministry's specific responsibilities, additional paragraphs have been introduced with a primary focus on several key aspects. These include the imperative for sustainable water resource management, preventing pollution when organizing water use for various activities, promoting the utilization of renewable water sources such as rainwater and wastewater recycling, implementing necessary measures for the conservation of the Nile and other major waterways, ensuring effective control and monitoring of water resources, undertaking well-digging and conducting studies to assess groundwater quantity and status, and dedicating efforts to agricultural projects while regulating the utilization of both wastewater and drinking water. Finally, it is also amended Article 19 dealing with Penalties.
