Abstract
This Act applies to contractual terms that businesses use when offering goods, services, or other benefits to consumers. The Act also applies to contractual terms used by businesses when they mediate such offers from another business or from someone else. If a contractual term referred to in Section 1 is deemed unreasonable towards the consumer considering the price and other circumstances, the Patent and Market Court may prohibit the business from using the same or substantially similar terms in similar cases in the future. A prohibition shall be accompanied by a penalty fee, unless this is unnecessary for special reasons. An application for a prohibition may be made by the Consumer Ombudsman, or an association of businesses, consumers, or employees. If necessary for supervision under this Act, the Consumer Ombudsman may purchase goods, services, or other commodities under a concealed identity (test purchases).
