Act on Procurement in the Water, Energy, Transport and Postal Services Sectors (SFS 2016:1146).

This Act provides rules for the procurement of goods and services by public entities ("contracting entity") related to business in the fields of water, energy, transport or postal services ("the supply sectors"). Procurement refers to the measures taken for the purpose of procuring goods, services or works by the award of contracts. The Act also applies when a contracting entity organizes procedures for the awards of projects by competition. Rules on procurement can also be found in other legislation (e.g. Acts 2016:1145 and 2016:1147). The Act implements Directive 2014/25/EU of the European Parliament and of the Council on procurement by entities operating in the water, energy, transport and postal services sectors and repealing Directive 2004/17/EC. Section 3 sets out when this Act applies to the supply of potable water and other waterworks. The Act also concerns the award of "mixed contracts", which involves also the award of concessions.
