Abstract
This Regulation of the Environment Protection and Energy Department, made under provisions of Chapter 14 the Swedish Environmental Code, provides rules for the makes provision for the approval and management of pesticides, which may be in the form of plant protection products or biocidal products. The Regulation completes rules as laid down by the Environmental Code and the main EU Regulations in the field of plant protection products management, i.e. Regulation (EU) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market and Regulation (EU) No 528/2012 of the European Parliament and of the Council concerning the making available on the market and use of biocidal products. Unless otherwise specified in this Regulation, terms in the Regulation have the same meaning as in the EU Regulations. Rules on control and supervision for purposes of this Regulation and the EU Regulations can be found in Chapter 26 of the Environmental Code and in the Environmental Control Regulation (SFS 2011:13). The Swedish Chemicals Agency shall be the main supervisory and regulatory body for purposes of Regulation (EC) No 1107/2009. It examines the issues of authorization, approval, dispensation and other measures already examined in other Member States in accordance with Regulation (EC) No 1107/2009. Before the Swedish Chemicals Agency determines such an issue, it must hear, if clearly required, the Swedish National Agricultural Agency and the Swedish Food Agency and the Swedish Forest Agency, if forest land is affected. the Regulation concerns, among other things, protection of water resources from pesticides.
The Regulation makes provision with respect to notification to the Chemicals agency of changes in classification of plant protection products and recording of information on plant protection products, the classification of products approved under Regulation (EU) No 1107/2009 by the Agency after assessment of assess the health and environmental risks, labelling of products in Swedish, training for the handling of plant protection products and training certificates, permit for use of plant protection products (which shall be issued by the competent authority according to the use of products), authorization for the distribution of products, (restrictions on) use of plant protection products and further regulation by various authorities, information to the public, equipment for the spreading of plant protection products, and the preparation of a national action plan in accordance with Article 4 of the EU Regulation establishing a framework for Community action to achieve the sustainable use of pesticides (2009/128/EU) and calculation of harmonised risk indicators in accordance with Article 15 of that Regulation.
The Regulation provides rules for the placing on the market and use of biocidal products (Chapter 3). For biocidal products that do not qualify for approval pursuant to Regulation (EU) No 528/2012, Chapter 4 of this Regulation also applies. Also for biocidal products the Swedish Chemicals Agency examines the issue of permits, approvals, exemptions and implements other measures to taken in accordance with Regulation (EU) No 528/2012, but in certain circumstances it must hear the Swedish National Agricultural Agency and the Swedish Food Agency, and, if forest land is affected, the Swedish Forest Agency. Handling of biocidal products requires specified skills as specified. Use of biocidal products shall be supervised or regulated by specified public bodies.
Chapter 4 concerns biocidal products that are not subject to EU approval requirements. This Chapter applies only to biocidal products referred to in 1. Article 89 (2) or 93 of Regulation (EU) No 528/2012 of the European Parliament and of the Council; or 2. Article 21 of Commission Delegated Regulation (EU) No 1062/2014. Again, the Swedish Chemicals Agency shall be the main supervisory and regulatory authority. The Agency may issue Regulations on the conditions for approval that shall apply regarding the product's composition, manner of use and properties in general, and matters required for control purposes. The Regulation sets out procedures for approval and provides rules for storage and handling of relevant products, and the packaging and labelling of products and their use.
