Abstract
This Act regulates the possession, use, import, transfer and transportation of biological agents and toxins that are known to be hazardous to human health and provides for safe practices and security in the handling of such agents and toxins.
The Act groups into different Schedules microbial agents and toxins in order to reflect the different containment levels, security measures and licensing permits/approvals needed.
The Director of Medical Services and his appointed officers are responsible for administering and enforcing the Act, which covers the following aspects: prohibit the use of biological agents and toxins for non-peaceful purposes; prohibit the use of Second Schedule biological agents without approval; prohibit the possession of First, Second and Fifth Schedule agents without approval; prohibit the transhipment of First, Second and Fifth Schedule biological agents and toxins without permit; prohibit the import of all schedule biological agents and toxins without permit; prohibit the transportation of all schedule biological agents by mail or public transportation; prohibit large scale production of Second Schedule biological agents; and prohibit large scale production of First and Third Schedule biological agents without approval.
The Act further provides for: duties and obligation of operators, bio-safety committees, bio-safety coordinators and staff of facilities; procedures and requirements for obtaining approvals, permits and certification of facilities; powers of the Director of Medical Services to enter, inspect and search any premises; offences and penalties; etc.
