Abstract
These Regulations, made under provisions of subsection (1) of section 193 of the Mines and Minerals Development Act 2023, concern protection of all ownership rights and interests connected to minerals, and all the activities relating to the development of minerals and mining activity. The Regulations define the following relevant terms: accident; affected community; authorised medical practitioner; community development agreement; community development fund; beneficial interest; community land; compensation; economic displacement; emergency suspension; environmental impact assessment; exporters' licence; family land; landowner; land use agreement; large-scale mining; lease; mining cadastre office; precious mineral; registered land; reserved area; serious offence; strategic minerals. The Regulations cover the following matters: administrative matters and Ministerial powers, duties and responsibilities; designation of mining area and exploration rights; issuance of licences for exploration, small-scale and large scale mining; obligations of holder of licence; measures for ensuring environmental protection, social protection, protection of public health; community management and development; financial measures, accountability and transparency; discovery and removal of cultural or archaeological relics; offences and penalties.
