This Act aims to regulate the profession of pharmacy; to control the supply, manufacture, storage and transportation of drugs, including nutritional agents and cosmetics; and to provide for other matters related thereto. The Act specifically provides for the Pharmacy Board; regulation of the pharmacy profession; control and supply of drugs; control of manufacture and storage of drugs; control of transport, import and export of drugs; further restriction on narcotics; and powers of entry and investigation. The Act defines “drug” as any substance or preparation used or intended to be used for internal or external application to the human or animal body either in the treatment or prevention of disease or for improving physiological functions and it includes nutritional agents and cosmetics. Among others, the Act provides that no person shall consign any Class A Part II drugs for transportation unless it is consigned in a container bearing a label indicating that the container should be kept away from food and from any thing likely to come into contact with food. No person shall carry in any vehicle in which food is being carried, a container bearing a label such as is described in subsection (l) unless (a) the container is carried in a part of the vehicle effectively separated from the food; (b) the food is otherwise adequately protected from the risk of contamination. The term “food” above includes anything intended for human or animal consumption.
