Abstract
Somali Petroleum Law has the purpose to confirm sovereign right of Somalia to explore, develop, utilize and manage its petroleum resources onshore and off shore; to provide maximum benefit to Somalia and its people from the development and production of Petroleum; to ensure the protection, conservation and preservation of the environment in the conduct of Petroleum Operations; to establish the Somalia Petroleum Authority as the competent regulatory authority to regulate Petroleum Operations; to establish the Somali National Oil Company as an entity Controlled by the Government for the participation in Petroleum Operations in Somalia; to comply with international initiatives; and to ensure fair treatment of specified legal persons holding rights pursuant to Petroleum grants, etc.
Art. 11, environmental protection, establishes that petroleum companies that hold licenses should protect the environment of the areas affected by theirs operations in accordance with national laws, international treaties on the environmental protections. Those companies should protect the safety of: humankind; animals; farm and pasture; seaside; rivers; lakes; atmosphere; land/Sand. The Federal Government of Somalia must ensure that those companies fulfill their obligation. Petroleum licenses for exploration are issued by the government of Somalia and Chapter III provides for the regulation of these agreements. Penalties and provisions concerning access to information are as well considered under this law.
