Act to amend the Act on Regional Bodies and the Water Boards Act 1931 (S.B. No. 28 of 2005).

This Act amends the Act on Regional Bodies and the Water Boards Act 1931 for the purpose of reactivating Water Boards and to provide for coordination between Water Boards and regional administrative bodies in the framework of functional and geographical decentralisation. The amended Water Boards Act provides that Water Boards are established, modified or abolished by State Order of the Minister responsible for regional administration. For the areas where no Water Board is established, the regional body shall be responsible for the administration of water resources.
This Act sets out rules for the internal organization, administration and supervision of Water Boards. For each Water Board a Statute shall adopted. Water Boards may adopt water ordinances (Keur) for the management of water resources in the area of jurisdiction. This Ordinance may require farmers to carry out certain obligations for more sustainable agriculture. The Keur must be approved by the Minister and published in the Official Gazette. The Minister is the supreme supervisory authority for Water Boards but may delegate his or her powers to District Commissioners. Water Boards shall report to District Commissioners.
