Regulation of Imports and Exports Act, 2012.

Comprising seven chapters and a total of 54 articles, this Act establishes a legal framework for the regulation of imports and exports in South Sudan. The Director in charge of the trade Directorate within the Ministry, in collaboration with the Minister responsible for commerce and industry, administers the provisions of this Act. To assist in carrying out the Act's functions, the Minister has the authority to appoint an Advisory Committee.
Chapter III outlines the regulatory framework governing the import and export of goods, including provisions for licenses, penalties for violations, and the Minister's discretionary powers, and includes the following principal points (i) goods prohibited from being imported into South Sudan, as well as restricted goods that can only be imported with a special license issued by the Minister; (ii) similar to imports, certain goods are prohibited and restricted from being exported out of South Sudan, with restricted goods requiring a special export license; (iii) to import or export goods, excluding restricted items, it is required to apply for a general import or export license and a prescribed fee must be paid regardless of the product type or quantity; (iv) the Minister has the authority to (a) exempt specific individuals, conveyances, or goods from certain provisions of the Act, (b) modify conditions specified in a special license, (c) cancel a special license if conditions are violated or if the license was obtained based on false information. Chapter IV empowers authorized officers to (i) deny imports/exports without a license, (ii) request information/documents related to goods, (iii) summon vessel masters for inspection, (iv) halt port clearance, (v) inspect containers, (vi) demand license production, (vii) examine goods/packages and collect samples for testing, and (viii) search individuals and luggage. Chapter VI addresses offenses and associated penalties.
