Abstract
This Act, consisting of 29 sections Organized into IV Parts, aims to promote fair trading practices and protect consumers in Eswatini. Its primary objectives include preventing misleading conduct, false representations, and unfair commercial practices, all of which are addressed in Part II, including the prohibition of importing goods with false trade descriptions or trademarks (Section 19). The Act establishes key legal measures, such as injunctions to prevent violations and mandates for disclosing information and publishing corrective statements (Section 23). It also sets compliance requirements for businesses, ensuring that advertisements are truthful and adhere to fair trading standards. Additionally, Section 27 grants the Minister authority to authorize searches in cases of suspected violations.
