Abstract
The Act is about implementation of the Treaty on the Establishment and Functioning of the Joint Water Commission between the Government of Swaziland and the Government of the Republic of South Africa and the Treaty on the Development and Utilization of the Water Resources of the Komati River Basin between the Government of the Republic of South Africa and the Government of Swaziland. I appoints the Minister responsible for natural resources as the authority responsible to ensure that the terms of the Komati River Basin Treaty and Joint Water Commission Treaty are fully implemented in the best interests of Swaziland. The Minister may by Legal Notice published in the Gazette make regulations for generally carrying out the principles and purposes of this Act. The Act concerns the implementation of waterworks as foreseen in the Komati Treaty and the status and operation in Swaziland of the Komati Basin Water Authority and the Joint Water Commission.
Subject to the terms of the Komati River Basin Treaty, the Government may— (a) construct and operate within Swaziland hydro-electric power complexes at any darn in the Komati River Basin; (b) utilise within Swaziland the reservoir areas or other sites under the control of KOBWA for the promotion of tourism or for the development of the recreational or commercial potential of such area or site. The Government shall use its best endeavours— (a) to minimize waste and non-beneficial use of water from the Komati River Basin within Swaziland; (b) to ensure that the necessary steps are taken to prevent water pollution in the Komati River Basin within Swaziland; and (c) to minimize soil erosion in the Komati River Basin within Swaziland. Compensation in respect of rights or interests in land, servitude, fishing rights, water rights or any other rights affected by the project within Swaziland shall be paid by the Government in accordance with the laws of Swaziland. The Minister shall take all reasonable measures to ensure that the design, construction operation and maintenance of the project are, within Swaziland, compatible with the protection of the existing quality of the environment, and in particular the Minister shall pay due regard to the maintenance of the welfare of persons and communities which are immediately affected by the project.
