Abstract
This Act, comprising 16 articles and 7 Schedules, establishes the Eswatini Sugar Association to (i) regulate the sugar industry by the Agreement outlined in Part I of the Schedule, which is binding on all millers, growers, millers-cum-planters, refiners, and other stakeholders involved in the industry; (ii) advise the Minister on matters related to the sugar industry. Any amendment or alteration to the clauses of the Agreement specified in Part II of the Schedule is invalid without the Minister's prior written consent. Article 8 establishes a quota board, as provided in Chapter III of the Agreement, which, together with the association, shall exercise all powers and perform all functions assigned to them under the Agreement. Article 11 deals with restrictions on the cultivation of sugar cane and the manufacture, refining, importing, and exporting of sugar and provides that (i) sugar cane cultivation, as well as the manufacture, refining, import, and export of sugar, is strictly regulated (ii) only those with a duly allocated quota or Ministerial permission may cultivate sugar can; (iii) sugar manufacture requires a milling license, while refining is allowed only as part of manufacturing or with a special permit; (iv) the Minister may grant, modify, or revoke refining permits; (v) the Eswatini Sugar Association has exclusive rights to import and export sugar unless the Minister grants permission to others under specified conditions. After consulting the association, article 12 empowers the Minister to set maximum wholesale and retail prices for different types or grades of sugar sold in Eswatini, with variations based on user classification. The Minister may also amend or revoke such price regulations through a notice in the Gazette. Penalties are provided in Article 13.
The Schedules include (i) the Agreement, (ii) growers' quotas, (iii) approved cane varieties, (iv) sucrose determination and distribution in cane, (v) temporary additional growers' quotas, (vi) the Eswatini Sugar Association Constitution, and (vii) the formula for calculating the price per ton of sucrose delivered to growers.
