Abstract
This Act, consisting of 75 sections divided into 9 Chapters, provides for the requirements to produce, use and trade in fertilizers.
The Fertiliser Committee shall be established to provide recommendations or opinions to the Minister or the Director-General on: (1) granting permission for the manufacture of fertiliser or the sale, import, export or transit of fertiliser; the registration or revocation of registration of fertiliser; or the suspension or revocation of a licence; (2) prescribing the rules, procedures, and conditions relating to the manufacturing, selling, importing, exporting, or transiting of fertiliser; etc. In order to manufacture for commercial purposes, sell, import, export or transit the fertilisers as prescribed in Section 12, a licence issued by by a competent official shall be obtained. Any person licensed to manufacture for commercial purposes or import fertiliser who wishes to manufacture or import other types of fertilisers, excluding a standard chemical fertiliser and the fertilisers referred to in section 34 (4), shall apply to the competent official for registration thereof first; and upon receipt of a certificate of such registration, that person is entitled to manufacture or import the fertiliser. Manufacturing for commercial purposes, selling or importing counterfeit fertilisers, non-standard chemical fertilisers, deteriorated chemical fertilisers and non-standard bio or organic fertilisers are not allowed. The Minister shall have the power to publish standards for chemical fertilisers, stipulating, changing or cancelling the formula thereof, the minimum or maximum guaranteed quantity of a nutrient or toxic substance in the chemical fertiliser, a list of materials to be used as containers or packages for fertiliser, determination of the net weight or volume of fertiliser in a package or container for commercial purposes; determination of the methods of analysis, and standard deviations for the analysis and inspection, of fertiliser samples; the maximum amount of a toxic substance allowed in a fertiliser; etc. The Act makes further provisions for inspection, offences and penalties.
