Abstract
This Act is enacted to control and supervise herbal products for humans. The Act consists of 127 Sections.
Anyone who wishes to engage in the business of producing, importing, or selling herbal products that the Minister has announced in accordance with section 6 (1) must obtain a license. Licenses for herbal products are divided into the following categories: (1) License to produce herbal products. (2) License to import herbal products. (3) License to sell herbal products. There shall be a committee called The National Herbal Policy Committee shall be established. The Policy Committee's duties and powers include: (1) Set the national policy and strategic plan for herbal products every five years; (2) Give opinions or recommendations to the Cabinet on matters related to the budget or other matters related to policies and strategic plans under (1); (3) Monitor and evaluate the performance of relevant agencies; (4) Establish measures to prevent and solve problems arising from herbal products; etc. There is a Herbal Products Committee responsible for providing advice to the Minister of Public Health in setting criteria to control and supervise herbal products with a licensing system.
The Act further makes provisions for: duties of the licensee and the person responsible for the operation, registration of herbal product formulas, notification of details and registration of herbal products, control of herbal products, advertisement, penalties, etc.
