Abstract
The Act is divided into 15 Chapters: General Provisions (I); Working Conditions on Board (II); Recruitment for a person to work as a seafarer (III); Employment Conditions (IV); Repatriation (V); Damages in the case where a ship is damaged or shipwreck (VI); Manning Level (VII); Standard of accommodation, facilities, food and nutrition on board (VIII); Medical care, protection of life, body and hygiene of seafarers (IX); Maritime Labour Certificate and Declaration of Maritime Labour Compliance (X); On-board complaint procedure (XI); The right to form a union and bargain (XII); Competent Official (XIII); Maritime Labour Committee (XIV); Penalties (XV).
A ship-owner shall ensure that a seafarer is protected in respect of social security and compensation in accordance with rules, procedures and conditions as prescribed by the Minister of Labour (sec. 4). A ship owner shall ensure that a copy of Maritime Labour Convention B.E. 2549 and this Act including its amendments are held on board (sec.12). No ship-owner shall allow a person under sixteen years of age to work on board a ship (sec.15). In order to recruit a seafarer working on board a ship, a permission shall be obtained from a Registrar of the central recruitment under the law on recruitment and protection of job seekers (sec.21). A ship of five hundred gross tonnage or over, engaged in international voyages are required to obtain a maritime labour certificate certifying that the working and living conditions of seafarers on the ship are complied with the conditions as specified in the declaration of maritime labour compliance issued under this Act (sec.86). Seafarers or ship-owners have the rights to form a union in order to bargain or request the rights or benefits relating to employment condition and working conditions under this Act (sec. 90). The Act further makes provisions, inter alia, employment agreement, minimum wage, overtime pay, insurance for each seafarer in relation to repatriation of a seafarer, compensations for damages in the case where a ship is damaged or shipwreck, establishment of the Maritime Labour Committee and the duties thereof, offences and penalties, etc.
