Abstract
This Requirement of Contributions to the International Fund for Compensation for Oil Pollution Damage Caused by Ships Act, B.E. 2560 (2017) establishes Thailand's legal framework for contributing to the International Fund for Compensation for Oil Pollution Damage. The Act aims to ensure adequate compensation for oil pollution damage and promote environmental protection. It applies to pollution damage in Thailand's territory and exclusive economic zone, and preventive measures taken to avoid such damage.
The Fund, recognized as a juristic person, compensates for pollution damage in the case where the amount of liability under the law on civil liability for oil pollution damage caused by ships is inadequate. Any person who has received the contributing oil in total quantities exceeding 150,000 metric tons in each calendar year has the duty to make annual contributions to the Fund. The Act specifies conditions under which the Fund pays compensation. The Act also makes provisions for: reporting and payment procedures, the process for claiming compensation, offences and penalties.
