Abstract
This Constitutional Law regulates the formation, powers, and activities of local state authorities. It defines local state power as consisting of representative bodies (the Majlis of People’s Deputies at the levels of Gorno-Badakhshan Autonomous Oblast, regions, Dushanbe city, cities, and districts) and executive bodies headed by the respective chairpersons. The Law establishes key concepts, principles of activity—such as legality, protection of human rights, public accountability, collegiality, and unity of command—and clarifies the legal basis of local governance as grounded in the Constitution, national legislation, and international legal instruments recognized by Tajikistan.
The Law details the organization, election, and powers of the Majlis of People’s Deputies, which serves as the main local representative body elected for five years through universal, equal, and secret suffrage. These bodies approve and oversee local budgets, set local taxes within the law, manage communal property, adopt socio economic and environmental programs, approve or express no confidence in chairpersons, and issue binding resolutions. The Law also regulates sessions, commissions, legislative acts, and the legal status of deputies, including grounds for early dissolution of a Majlis and procedures ensuring transparency and accountability.
Significant attention is given to the role of the chairperson as the head of local executive authority, appointed by the President with approval of the Majlis. The chairperson oversees implementation of laws, manages communal property, prepares and executes local budgets, coordinates local structures of central executive bodies, and ensures public order and social services. The Law further establishes the economic and financial foundations of local authorities, including property rights, budgetary revenues and expenditures, reserve funds, and external economic activities, as well as procedures for judicial review, prosecutorial oversight, and accountability for violations of the law.
