Government Resolution No. 72 validating the Regulation on the procedure for inclusion in and exclusion from the State Register of Plant Varieties, as well as keeping the State Register of Plant Varieties.

The procedure for including and excluding varieties in/from the State Register of Plant Varieties, as well as its maintenance, establishes the relations associated with the inclusion and exclusion of plant varieties in/from the State Register of Plant Varieties and its maintenance. The inclusion and exclusion of plant varieties and hybrids is carried out primarily with the aim of ensuring agricultural production with the best plant varieties, preventing the use of plant varieties excluded from agricultural production and with expired period of use. In the case of the inclusion of new plant varieties and hybrids, it is guaranteed that they meet local requirements for agricultural production and have advantages in economically valuable traits relative to other cultivated varieties and hybrids. On the national territory is authorized the production, sale and use of seeds and hybrids included in the State Register. The inclusion and exclusion of plant varieties in/from the State Register, as well as its maintenance thereof, consists of the following: (a) protecting the interests of the state and agricultural producers from the import and use of new random and low-quality varieties and hybrids that are not used in agricultural production; (b) assistance in the cost-effective introduction into production of new high-quality plant varieties and hybrids of plants bred in the Republic of Tajikistan or in other countries; (c) ensuring free choice of plant varieties and hybrids by agricultural producers; (d) ensuring proper storage of plant varieties and hybrids for the entire period of their commercial use; and (e) ensuring the correct naming of commercial and protected plant varieties and hybrids. The following information is registered in the State Register: (a) code of plant varieties and hybrids; (b) name of plant varieties and hybrids; (c) year of inclusion in the State Register of Protected Plant Varieties and Hybrids; (d) originator number; (e) code of the country; (f) regions of cultivation of agricultural crops recommended for sowing on the national territory; (g) directions of use; (h) growing conditions; (i) category of seeds; and (j) terms of ripening.
