Governmental Decree No. 361 validating the Regulation on the procedure for classifying waterways as navigable, and rules for operation thereof.

This Governmental Decree defines the main tasks and duties of the inland water transport authorities on the classification of waterways and the rules for operation thereof. It applies to all navigable rivers, lakes and artificial waterways located on the territory of the Republic of Tajikistan. This procedure applies to border waterways when concluding a contract, agreements of the Republic of Tajikistan with foreign countries. Vessels navigating inland waterways of the Republic of Tajikistan shall be allowed to fly the flag of the Republic of Tajikistan. The list of rivers and lakes in which vessels are allowed to navigate is determined by the Ministry of Transport of the Republic of Tajikistan together with the Ministry of Land Reclamation and Water Management of the Republic of Tajikistan and is coordinated with the Government of the Republic of Tajikistan. All inland waterways are public routes. Internal waterways and navigable waterworks located on them are owned by the Republic of Tajikistan and are used for navigation by any legal entities and natural persons. Type and means of navigation equipment and the terms of their work, guaranteed dimensions of the vessels, the terms of operation of navigable waterworks are established by the Ministry of Transport and the Ministry of Land Reclamation and Water Management of the Republic of Tajikistan. It shall be prohibited to use the coastal strip for economic and other activities if such activities are incompatible with ensuring the safety of navigation.
