Abstract
This Regulation defines powers of the Ministry of Environmental Protection, the Ministry of Land Reclamation and Water Resources, the Committee for State Supervision over Safe Operation in Industry and Mining under the Government of the Republic of Tajikistan and the Chief Geological Administration. The aforesaid governmental executive bodies shall be specially authorized state bodies in the field of regulation of water use and protection. The Ministry of Environmental Protection shall have the following competence: (a) state supervision over enforcement of the national legislation on rational use and protection of water resources; (b) correct accounting by institutions, organizations and enterprises of the rational use of surface and groundwater and discharge of pollutants into environment; (c) control of water use permits; (d) control over effluent waste water discharge; (e) control over well sinking, drilling and mining operations; (f) control over application of ecological requirements to waterbodies; (g) issuance of permits for special water uses, except for agricultural irrigation; (h) issuance of permits for well sinking and drilling operations; (i) legal actions against enterprises, institutions, organizations and citizens, as well as against foreign legal entities and foreign natural persons for compensation of damages caused by environmental pollution and unsustainable use of water resources; and (j) keeping state water register of surface waters.
